City Cannot Force Mall Property Owner to Clean Up.

If a commercial property owner leaves trash, debris and litter along his property is he required by the City of Los Angeles to clean it up? Can Councilman Cardenas’ office step in and help?

Dear Mr. Hurvitz,

Thank you very much for providing our office with this information. We have contacted a non-profit organization named Volunteers of America to assist in cleaning up and removing the trash and debris. We have requested that this location be a routine stop for this group, until further notice.

Since we cannot force the property owner to clean up around his/her property, though it would benefit him/her the most, this is the best alternative that we can provide.

Thanks again, and please keep our office abreast on any other concerns you may have regarding this location.

  1. Why don’t all of us start dumping our garbage where all the crap is. In making it real bad, that may make property owner take notice or the city will have to step in. Patrick may cite me the city ordinance about littering…but Cardenas will write that it’s not the city’s job to make people put garbage in the bin.

  2. Ask the councilman what he makes of this:

    Los Angeles Municipal Code – SEC. 91.8104. BASIC MAINTENANCE AND REPAIR OF EXISTING BUILDINGS AND PREMISES.

    (Added by Ord. No. 171,175, Eff. 7/25/96.)

    Every existing building, structure, premises or portion thereof shall be maintained in conformity with the code regulations and Department approvals in effect at the time of such construction and occupancy unless specifically exempt by written approval of the Department.

    Every existing building, structure, or portion thereof shall be maintained in a safe and sanitary condition and good repair. The premises of every building or structure shall be maintained in good repair and free from graffiti, debris, rubbish, garbage, trash, overgrown vegetation or other similar material.

    91.8104.1. All physical elements of every existing building, structure or portion thereof shall be maintained by cleaning, painting, staining, refinishing or other restorative means, in a condition as close as reasonably feasible to their originally required and approved state.

  4. If the Council office contacted Building and Safety, I’m certain that the mess would
    disappear. If the Council office would contact the building owner directly, I’m certain he or she would do something about the dreadful condition of the building.
    The Volunteers of America are a wonderful group. But the owner, not VOA, is the responsible party.
    Van Nuys needs a council member who will show the community that he or she will
    promote a place that all the citizens will be proud to call theirs.
